Now here's a big surprise, judge says Obama's uncle can stay in US

Maria Sacchetti is reporting that a federal immigration judge ruled Tuesday that Barack Obama's illegal alien uncle can remain in the United States, sparing him deportation to his native Kenya in a case that riveted attention on the elderly man who had lived under the radar in this country for 50 years. For most of that time, he was here illegally.

Boston immigration Judge Leonard I. Shapiro -- the same judge that gave aunt Zeituni asylum -- said Onyango "Omar" Obama can now get a green card, and in five years, apply for US citizenship, unless the Department of Homeland Security appeals the case within 30 days.

"Congratulations," Shapiro said after he announced his decision. "Welcome to America."

The case stirred controversy because Obama's uncle was arrested in 2011 for drunken driving in Framingham and was found to have an outstanding deportation order from 1992. Many accused the government of giving him special treatment at the same time Obama is deporting record numbers of illegal immigrants.

But Shapiro said Onyango Obama was eligible for a green card under federal immigration law because he arrived in America before 1972 and had displayed "good moral character." The judge said the 69-year-old paid taxes, volunteered in the community, and was a "kind and decent" person.

During his testimony, Obama begged the judge for the chance to stay, saying he did not know Kenya anymore. He left at age 19 to come to the United States.

"America is a land of opportunities, a land of chances," Obama told the judge.

Obama also invoked his nephew's name during the hearing, which lasted more than an hour. Asked if he had relatives in the United States, he said he had two nieces; a sister, Zeituni Onyango, who appeared in court Tuesday; and his brother's son, Barack Obama.

"I do have a nephew," Obama said slowly. "He's the president of the United States."

The White House said last year that Obama had never met his famous nephew, but the uncle testified Tuesday that Barack Obama had stayed with him at his Cambridge apartment for three weeks when he came to attend Harvard Law School in the 1980s.

"It's a good thing to let your nephew stay with you," he said after the hearing, adding that in his family, "your brother's kids are your kids as well."

The White House did not respond to numerous requests for comment.

Obama’s uncle ordered to face deportation hearing at the end of the year

John Zaremba is reporting that Onyango Obama, Obama’s illegal-immigrant uncle, will have his final immigration hearing on Dec. 3, 2013, an immigration judge in Boston ruled this afternoon.

Obama, who has been illegally living in the USA for fifty years, had his case reopened last year after being arrested by Framingham police for drunk driving.  He will now be able to fight a twenty-year-old deportation order.

"Everybody wants to stay in America," Obama's attorney Scott Bratton said after the hearing.

Authorities ordered him deported in the 60s, the 80s and again in 1992, but he never left and instead lived quietly in Framingham as a liquor-store clerk. His immigration status came to light in the summer of 2011, when Framingham police arrested him for drunken driving. He famously quipped during booking that he would call the White House.

After fighting the case aggressively, he admitted in court last year that police had a strong case against him, and had the charges continued without a finding.

Obama went before immigration Judge Leonard I. Shapiro.  He's the guy that gave Obama's illegal alien aunt Zeituni "amnesty."

Anybody want to bet on the outcome of the December hearing?

DHS Confirms: Deportation of Obama's uncle on hold as immigration board re-opens case

Patrick Burke is reporting that The U.S Board of Immigration Appeals has agreed to reopen the immigration case of Onyango Obama, delaying the deportation of the 68-year old Kenyan who violated an order to leave the United States in 1992.
 
U.S. Immigration and Customs Enforcement (ICE), a division of the Department of Homeland Security, confirmed to CNSNews.com on Tuesday that Obama, who is Barack Obama’s uncle, was granted a rehearing last week and his case is being re-opened.
 
"The Board of Immigration Appeals (BIA) remanded the case back to Executive Office for Immigration Review (EOIR) for reconsideration. It is inappropriate for ICE to offer any further comment on this case," Brian P. Hale, ICE assistant director for public affairs, said in a statement to CNSNews.com.
 
The Cleveland, Ohio-based immigration law firm of Margaret Wong and Associates, which is handling Obama’s case, said the delay may allow the Kenyan national to apply to stay in the U.S. permanently.
 
"We are delighted that the Board of Immigration Appeals has decided to reopen the deportation case of Obama's uncle, Obama Onyango," Wong said in a statement.
 
"Mr. Onyango now has an opportunity to stay in the U.S. and apply for permanent residency," the statement said. "Mr. Onyango is the brother of the U.S. president's late father and came to the U.S. in the 1960s on one of the last boat lifts."
 
In 1989, an immigration judge ordered Obama, who has been in the U.S. since 1963, to be deported. He appealed and the appeal was dismissed in 1992.
 
Crystal Williams, executive director of the American Immigration Lawyers Association, said any move to reconsider a case is unusual when there is already an order for removal.
 
"It isn’t common for the Board to reopen a case when there is an outstanding order of removal, as there is here, particularly with a later DUI arrest.  It happens, but not that often," Williams said in a statement to CNSNews.com.
 
CNSNews.com reported in July that an ICE internal e-mail obtained by the legal watchdog Judicial Watch had confirmed that ICE had granted Obama a stay of deportation "to seek reopening of his deportation proceedings."
 
The e-mail, sent by Hale to ICE Director John Morton on April 1, revealed that ICE had no immediate plans to deport Obama, in spite of a previous ICE order that granted Obama a stay of deportation until June 5, 2012.
 
"Mr. Onyango is subject to a final order of deportation. ICE had granted him a stay of deportation effective until June 5, 2012," the e-mail reads.
 
"The stay was granted to allow him to attend pending criminal proceedings and to seek reopening of his deportation proceedings, which concluded before the Board of Immigration Appeals on January 29, 1992."
 
Obama was arrested in Framingham, Mass., for DUI in August 2011. In March of this year, his case was continued for one year and his driver’s license was suspended for 45 days.
 
According to the Boston Globe, Obama subsequently received a "hardship" license so he could continue working at his job as the manager of a liquor store.

It is illegal for an illegal alien to posses a driver's license in the Commonwealth of Massachusetts!

I was listening to Boston radio personality Howie Carr on the way home from the range yesterday and he was railing about this case.

He said that he personally called the Registry of Motor Vehicles and asked them why Onyango had a driver's license when it was illegal for him to have one.

No one at the Registry would or could provide Carr with an answer.

And let's not forget Obama's other deadbeat relative, Auntie Zeituni.

ICE Stonewalls on status of uncle Onyango Obama

Judicial Watch is reporting that following the publication of embarrassing internal government emails by Judicial Watch, the Homeland Security agency responsible for deporting criminal illegal immigrants is dodging questions about President Obama’s illegal alien uncle, who got busted for drunken driving last year in Massachusetts.

The case received widespread media coverage because the commander-in-chief’s uncle, Onyango Obama, had previously been deported to his native Kenya yet lived and worked in the Boston area and threatened to call the White House after getting arrested. He also had a valid Massachusetts drivers’ license, which was temporarily suspended after his drunken-driving arrest but, incredibly, has been reinstated by the state’s Registry of Motor Vehicles.

Uncle Onyango has also received special treatment from the feds, according to government documents obtained by Judicial Watch. They weren’t easy to obtain because the administration clearly wants to keep details of the case from the public, despite promises of unprecedented transparency. JW had to sue for the information, which was made public this month.

The records, released by JW in two parts (click here and here to see them), show that Immigration and Customs Enforcement (ICE) withheld information on Uncle O’s release from the press and Congress and that the agency curiously permitted him to seek the reopening of deportation proceedings that had been closed in 1992. ICE leadership also tracked the politically sensitive case and granted Uncle O a special stay of deportation.

The records also include an embarrassing internal agency email from Brian Hale, ICE’s Assistant Director of the Office of Public Affairs, to ICE Director John Morton dated April 1, 2012, titled “Onyango Statement and TP’s [Talking Points].” The email (on page 43) confirms that ICE gave Barack Obama’s uncle favorable treatment.

We know that Uncle Onyango still lives and drives in the Boston area but the Obama Administration refuses to reveal the next step. Will Homeland Security officials sit idly by while an illegal immigrant with a DUI roams freely? Judicial Watch spent a great part of the week trying to get answers by repeatedly contacting ICE officials in Washington D.C. The question JW posed was simple: What is the status of the Onyango Obama case? The public certainly has the right to know.

But ICE blew JW off repeatedly. Multiple phone calls and messages to the ICE Public Affairs Office went unanswered before an agency spokeswoman named Gillian Christensen demanded the question be put in writing and sent to her email address at Gillian.Christensen@DHS.gov. Multiple emails and several days later, JW has not received a response.

Obama administration granted deportation stay to Obama’s illegal alien uncle

Judicial Watch, the organization that investigates and fights government corruption, announced today that it has uncovered a new record from Immigration and Customs Enforcement (ICE) regarding President Obama’s illegal alien uncle, Onyango Obama, who was arrested in August 2011 on drunken driving charges in Framingham, Massachusetts.

The document, obtained pursuant to a Freedom of Information Act (FOIA) lawsuit filed on April 10, 2012, includes an internal agency email from Brian Hale, ICE’s Assistant Director of the Office of Public Affairs, to ICE Director John Morton dated April 1, 2012, titled “Onyango Statement and TP’s [Talking Points].” The email (on page 43) confirms that the ICE curiously permitted Onyango to seek the reopening of his deportation proceedings closed in 1992:

Mr. Onyango is subject to a final order of deportation. ICE had granted him a stay of deportation effective until June 5, 2012.

The stay was granted to allow him to attend pending criminal proceedings and to seek reopening of his deportation proceedings, which concluded before the Board of Immigration Appeals on January 29, 1992.

On March 27, 2012, the Framingham Massachusetts District Court entered its judgment in Mr. Onyango’s criminal case. Since his criminal case has concluded and his attorney appears not to have filed a motion to reopen, ICE is requiring Mr. Onyango to report to our Office of Enforcement and Removal Operations in Burlington, MA on April 12,2012 at 10:30 a.m. with his attorney of record.

At that appointment, arrangements, including medical accommodations, will be discussed to effectuate his departure from the United States on an appropriate date.

Absent a change in circumstances, ICE does not intend to deport him at the time of his April 12 appointment.

Onyango was first ordered out of the country in 1989.

On March 27, 2012, Onyango Obama admitted to the Framingham District Court that prosecutors had enough evidence to convict him. Immigration and Customs Enforcement (ICE) officials, meanwhile, claimed the agency intended to continue deportation proceedings against Obama, however, they allowed Onyango to seek the reopening of his deportation proceedings.

Obama, who, upon his arrest, said his one phone call would be to the White House, has indicated he will fight ICE’s efforts to deport him in a high profile proceeding the Boston Herald conjectured could “drag on for years.” While he fights deportation, Obama will be allowed to drive a car. He was supposed to lose his license for 45 days, but received a “hardship license,” from the Massachusetts’s Department of Motor Vehicles so that he could drive back and forth to his job at a liquor store.

On July 12, Judicial Watch released records showing agency officials withholding information on Onyango’s release from the press and Congress.

“It certainly appears that Obama’s uncle is receiving favorable treatment from the Obama administration, which explains that we had to sue in federal court to obtain this material,” said Judicial Watch President Tom Fitton. “ICE should have deported Onyango immediately, especially after his DUI. We now know that the Obama administration decided not to deport Obama’s uncle despite his being a criminal and being on the lam for at least 20 years.”

As Director of ICE, John Morton has led the implementation of President Obama’s illegal alien amnesty program. On June 30, 2010, Morton sent a memo to all ICE employees instructing local immigration officials to use their discretion in “prioritizing” illegal immigration deportation cases. On June 17, 2011, John Morton followed up with another memo to all field officers, special agents and to the chief counsel further defining the term “prosecutorial discretion,” which, in essence, asked immigration officials to focus deportation proceedings on illegal aliens convicted of crimes.

That's now the second one of Obama's illegal alien relatives that have hit the amnesty jackpot!

Obama's illegal alien uncle gets his license back

John Zaremba is reporting that Obama's illegal-alien uncle is once again a fully legal Massachusetts driver, reclaiming his license this afternoon after serving a 45-day suspension he agreed to as part of a plea deal in a drunken-driving rap.
 
Onyango Obama, 67, walked into the Registry of Motor Vehicles' Worcester branch about 2:30 this afternoon and walked out moments later with a new license, according to RMV spokeswoman Sara Lavoie. Obama had been driving for about a month and a half on a hardship license, which allowed him to get behind the wheel only during certain hours.
 
"The hardship restriction was lifted today as allowed by law," Lavoie said.

Obama has held a Massachusetts license since at least the early 1990s, officials say; the RMV does not check immigration status and Obama did have a valid Social Security number as required.
 
Framingham cops busted Obama on drunken-driving charges in August. After posting a vigorous fight to the charges early on, he pleaded to the facts of the case in March, meaning he admitted police had enough evidence to convict him. The case was continued without a finding for a year, meaning he will avoid further punishment if he stays out of trouble.
 
Obama, of Framingham, is the half-brother of Barack Obama's late father, and the brother of Obama's aunt Zeituni Onyango, who won a controversial fight for asylum in 2010. He came to the United States from Kenya in 1963 to study at prep school, and lived quietly in Boston and Framingham over the years. A judge ordered him deported in 1992 for what his local lawyer said was a failure to renew his visa. His immigration attorney, Margaret Wong, has repeatedly declined to comment on the pending immigration challenge.
 
Immigration lawyers say Obama's fight against deportation could take years. They expect him to argue that returning to Kenya would put him in danger.

That argument worked for Zeituni, but the bigger question is how is an illegal alien "part of the Social Security system?"

And bigger than that, how many millions of illegals are part of the Social Security system?

Onyango on ICE

John Zaremba is reporting that Barack Obama’s illegal-alien uncle met yesterday with federal immigration officials, who say they’re pressing ahead with his deportation as he prepares his legal fight to stay in the country.
 
Onyango Obama, 67, of Framingham will be required to report regularly to U.S. Immigration and Customs Enforcement officials after their meeting at an undisclosed location, the agency said in a statement.
 
"ICE met with Mr. Onyango and his attorney today," ICE spokesman Brian Hale said in a statement yesterday, referring to the president’s uncle by the last name the agency has on file for him. "Pursuant to this meeting, Mr. Onyango will be required to check in regularly with immigration officials pending his removal. Absent a change in his immigration status or any related court proceedings, Mr. Onyango will be required to report to ICE in the coming weeks in order to effectuate his departure from the United States."

Obama is a Kenyan national who has lived in the U.S. since 1963 and was ordered deported in 1992, after what his attorney said was an unwitting failure to renew his visa. His immigration status was unearthed in August, when a Framingham cop arrested him for drunken driving. In a plea deal last month, he lost his license for 45 days but scored a special "hardship" license just days later, arguing he must drive to his job as a liquor store manager.
 
Obama’s immigration attorney, Margaret Wong, could not be reached yesterday. Wong helped Obama’s sister, Zeituni Onyango, win asylum in 2010.
 
Immigration experts have predicted Obama will appeal the 20-year-old deportation order and apply for asylum on the grounds that the Kenyan embassy was bombed by al-Qaeda in 1998, and that hostility toward the U.S. would put the president’s uncle in danger. The Obamas reportedly have hundreds of relatives living in western Kenya.

Long road out for Obama kin

Erin Smith and John Zaremba say uncle could stall deportation for years.

Booting Barack Obama’s illegal immigrant uncle out of the country could be a painstaking process that might drag on for years and may not even end in deportation if the aging Kenyan can convince the feds he should be granted asylum, immigration experts said.
 
The Herald learned yesterday that Onyango Obama, 67, is being summonsed to the Burlington offices for U.S. Immigration and Customs Enforcement next week to arrange his pending deportation. It’s just the beginning of what is sure to be a high-profile case.
 
"His nephew is the leader of the Democratic party in the U.S. and the leader of our political system, so he could argue there could be a lot of people outside the U.S. who could target him," said Boston immigration attorney Desmond FitzGerald. "In Kenya, they bombed our embassy, so there’s probably really good evidence that there are groups that are hostile to our country."

Obama's uncle will first have to overturn his deportation order and then petition for asylum, a two-step process that could last four years and cost Obama up to $10,000, FitzGerald said.
 
That’s still less than the $12,500 immigration officials estimated it costs taxpayers per deportation at a congressional hearing last year. Last fiscal year, the U.S. deported nearly 400,000 people.
 
Efforts to reach Obama’s immigration lawyer, Margaret Wong -- who successfully represented Obama’s sister, Zeituni Onyango, in her quest for asylum in South Boston in 2010 -- were unsuccessful yesterday.
 
Obama, who has been living in the U.S. illegally since 1963, was ordered deported in 1992 but remained stateside. He lived quietly in Framingham for years until an August arrest for drunken driving unearthed his immigration status. Last week, he admitted in court that police had enough evidence to secure a conviction.
 
Under the law, he was supposed to lose his license for 45 days, but the Registry of Motor Vehicles on Monday granted him a hardship license that allows him to drive from noon to midnight. The license was granted to help him get to his job as a liquor store manager in Framingham and North Grafton, but he may legally drive for other purposes as well, a registry spokeswoman said.
 
State Rep. George N. Peterson Jr. (R-Grafton) said he’s outraged any illegal immigrant could obtain a license.
 
"My first phone call (this) morning is going to be to the registrar. Somebody’s going to have to do some serious investigation," Peterson said. "This case highlights some of the issues we’ve heard about anecdotally -- illegal immigrants being able to drive with licenses or being able to register cars and being able to work."
 
In a statement, ICE officials confirmed yesterday they are pursuing Obama’s deportation.
 
"Now that (Mr. Obama’s) criminal case has completed, ICE has communicated, in accordance with standard procedure, with the attorney of record regarding his removal pursuant to a previous final order by an immigration judge," agency spokesman Brian P. Hale said.

On the road again

   

John Zaremba and O’Ryan Johnson are reporting that just a week after he copped a plea in a drunken-driving rap, Barack Obama’s illegal-alien uncle has landed a hardship driver’s license from the Registry of Motor Vehicles, making it perfectly legal for him to drive in Massachusetts -- even though the feds say he doesn’t belong here.

Onyango Obama, 67, who lost his regular license for 45 days last week, scored his limited license yesterday from the Registry’s Wilmington branch, after convincing a hearing officer that life without wheels would have posed an undue hardship on his livelihood as a liquor-store manager. Obama bolstered his case with a letter from his employer, Conti Liquors, as well as proof that he’d enrolled in an alcohol-treatment program.

“He met all of the criteria,” RMV spokeswoman Sara Lavoie said.

 

Of the state’s decision to award Obama a license even though the federal government considers him an illegal alien, Lavoie would only say, “Registry business is based on Registry records.”

The license allows Obama to drive from noon to midnight.

The license award drew fire from one advocate of tough enforcement on illegals, Bristol County Sheriff Thomas Hodgson.

“Our democracy is predicated on law,” Hodgson said. “When we start to interpret these laws differently and manipulate them the way we want them to work for certain people, we start to send a mixed message to people that the law doesn’t really matter. Its subject to interpretation. You don’t have to follow the law. They find ways to justify it. We need the laws to be very clear. We need ‘no’ to mean ‘no’ again.”

Hodgson, along with sheriffs in Plymouth and Worcester counties, stood up for Secure Communities, a program that feeds local police fingerprint checks into federal databases to check the citizenship status of accused criminals. Gov. Deval Patrick has refused to enroll the state in the program.

Obama, a Kenyan national, lost his license last week after admitting in court that Framingham cops had sufficient evidence to convict him in an August OUI bust. His lawyer, P. Scott Bratton, said Obama has an immigration hearing next month.

A judge continued Obama’s OUI case without a finding for one year, meaning he’ll face no further punishment if he stays out of trouble. Obama is the half-brother of President Obama’s late father, and the older brother of Zeituni Onyango, who was granted asylum in 2010.

Obama’s illegal alien uncle surrenders license for 45 days

John Zaremba is reporting that Onyango Obama -- Barack Obama’s illegal alien half uncle -- admitted to sufficient facts today in his drunken driving bust and his case is being continued without a finding for one year -- but he must surrender his license.
 
Obama, 67, was ordered to give up his license for 45 days, effective today, a Framingham District Court judge ruled. He left court without speaking to the press.

Obama had been waging an aggressive legal battle against Framingham cops ever since he was pulled over Aug. 24 for driving erratically and blowing 0.14 on a Breathalyzer. But his attorney today said it was time to move on.
 
"After a thorough review, we felt it was in his interests to end the matter without any further proceedings. He’s glad to have this behind him," said Obama’s attorney P. Scott Bratton.
 
The attorney added that Obama wants to "get on with his life" and to "get on with his normal quiet existence in society."
 
As for Obama’s illegal alien status, his attorney added the deportation proceedings were due to his failure to "renew immigration paperwork." Bratton said he expects that to be resolved, but he did not elaborate.
 
When he was arrested by Framingham police, he suggested his first call should be to the White House. A spokesman for the president told the Herald that call was never made. He actually called his boss at Conti’s Liquors.
 
Obama, who has been living illegally in the United States for nearly 20 years, has returned to work at Conti Liquors in Framingham.
 
Middlesex District Attorney Gerard T. Leone, Jr. said Obama has accepted responsibility for the "essence" of the charges.
 
"By admitting to sufficient facts today to operating under the influence and failure to yield at an intersection, the defendant has admitted responsibility for the essence of the crime he committed and has now been held accountable for his actions," Leone said.
 
The DA added Obama almost crashed into a Framingham police cruiser the night of the arrest. Once pulled over, the DA said Obama’s speech was slurred, "his eyes were red and glassy and there was an odor of alcohol coming from inside the motor vehicle." Obama then failed several field sobriety tests and his blood alcohol was almost twice over the legal limit.
 
Obama was also put on probation for one year.

Obama's uncle due in court in drunken driving case

My Fox Boston is reporting that Barack Obama's uncle will be back in court on drunken driving charges this week, when his lawyer is expected to ask a judge to toss out the results of a blood-alcohol test and statements he made to police.

Onyango Obama, the half-brother of the president's late father, was arrested in Framingham in August. A police officer said Obama made a rolling stop at a stop sign and nearly caused his cruiser to crash into Obama's sport utility vehicle.

Police said Obama registered 0.14 on a blood-alcohol test. The legal limit in Massachusetts is 0.08.

A judge is expected to hear arguments Thursday on a motion to suppress statements he made to police and the test results.

Immigration officials allege that Obama, originally from Kenya, violated a 1992 order to return to Kenya.
 

Everybody in this family is a serial lawbreaker, but hey!  If his nephew can hide all of his records, why shouldn't Onyango be able to suppress his?

The trials of Omar, Obama’s uncle -- continued

Sally Jacobs, the very liberal Globe writer, says Stephen "Hummer" Holmes, the soccer coach at the former Browne & Nichols School in Cambridge, was standing on a wind-whipped field in 1963 when he met the most talented soccer player he would ever work with.  A new student at school, that young man had loped on to the field barefoot and without shin guards, ready to play just as he did back home in Kenya.

His name was Omar Okech Obama.
 
"He had been playing without shoes for so long that the bottoms of his feet were so deeply calloused they were like shoe leather.  And his feet were so wide that he had to have special shoes constructed for him," recalled Holmes.  "But he never liked the shoes.  He’d say, 'Coach, I need to take the shoes off. Please, coach, I can’t feel the ball.'"

Browne & Nichols is a very expensive Harvard prep school.  Where do these people get their money?

That same Obama is now more famously known as the uncle of Barack Obama.  He rocketed into the news in August when he was arrested on charges of drunken driving in Framingham, Massachusetts, and told the booking officer, "I think I will call the White House."  As immigration officials consider whether to deport him, Obama, 67, finds his life in the United States the subject of intense curiosity not just by government officials and the media but among some family members and his old Cambridge classmates as well.
 
That spotlight has found him in the twilight of a meager life, nearly 50 years after he joined his older half-brother, Barack Obama Sr., in Cambridge to seek an education.  Notwithstanding the now-famous surname, his life here has mirrored that of countless others who have immigrated legally (he didn't), but then simply stayed on, barely making do at the margins of American life.

A lot of this has already been documented on this thread.  I'll pull out the new stuff:

For the past twenty years, he has ignored a deportation order.

Federal immigration law includes a little-used provision that allows immigrants who have been in the country continuously since before 1972 to be considered for permanent residence even if they are here illegally.  But they must also be of "good moral character."  If Obama is convicted of the drunken driving charge and the two related driving offenses he is charged with, he could be disqualified due to character issues.

Ahhh, here's the answer to the money.  Omar was directed to Browne & Nichols, a prestigious private boys school, by Ellen Frost, whose investment banker Dad was connected with the prep school.  He pulled strings and Omar Obama came to America for high school.  To  make a long story short, he screwed up, never graduated from high school, but simply stayed in Boston.

Was Ellen Frost one of Barack Sr.'s bimbos?

When Omar's brother Barack was thrown out of the country by Harvard and the INS and returned to Kenya in the summer of 1964.  Omar was hosted by a Newton family (Barney Frank's very liberal home town).  For reasons that are unclear, Obama withdrew from Browne & Nichols in the summer of 1965 and enrolled in what was then Newton High School.  Omar stayed at the Newton school for barely a year.  He left abruptly in 1966, apparently because his host family moved out of state, and did not graduate, according to a school spokesperson.

Obama returned to Cambridge to live with Kenyan friends and remained there for many years.  Then in his early 20s, he told others that he was enrolled in what was then Boston State College.

By the late 1980s, he began to encounter multiple problems, most of them financial.  In 1987 and 1988, "Omar H. Obama" failed to pay the IRS $3,876, according to a lien filed at the Registry of Deeds for Southern Middlesex County.  The agency later filed another lien against Obama, identified as Obama O. Onyango, saying he failed to pay $971 in taxes for 1990.  The court has no record that Obama paid either debt.
 
At the same time, immigration officials were also looking askance at Obama.  In 1989, an immigration judge ordered Obama to leave the country voluntarily.  It is unclear if the judge issued the order in response to Obama’s tax debts or for some other reason.  Obama appealed the order to the Board of Immigration Appeals but lost and was ordered deported in 1992.
 
He never left.
 
By the early 1990s, Obama Onyango had became the treasurer of a small convenience store in Dorchester called The Wells Market, according to state corporations records.  Despite his immigration problems, Obama worked there as a clerk and in 1994 he was attacked during an armed robbery.

When Obama failed to pay his rent, his landlady attempted to evict him and ultimately filed for unpaid rent of $2,200 in Boston Housing Court in 1999. Obama fled from the apartment.

At some point, Obama moved into a small house in Framingham with another Kenyan family.  For the past decade he has quietly worked the afternoon shift at the Conti liquor store on busy Route 126.

Onyango adopts Obama's strategy -- blame the other guy!

John Zaremba is reporting that lawyers for Barack Obama's illegal alien half-uncle are going after the patrolman who busted him on a drunken-driving rap, chasing internal affairs records they hope will paint him as a serial squad-car speeder.
 
Onyango Obama never would have been stopped and subjected to a breath test, which lawyers also are contesting, if it weren't for the cop's bad driving, his lawyers insist.
 
"It will be our contention that the officer nearly caused the accident by nearly hitting Obama," defense attorney William L. Harvey III told the Herald, saying he believes patrolman Val Krishtal was going "well above the speed limit" at the time of the near-crash.

Obama's attorneys said they want Framingham cops to cough up a paper trail on Krishtal, who, according to his own police report, nearly rear-ended the commander-in-chief's long-lost relative before making the Aug. 24 stop heard 'round the world.
 
"What's at issue is obviously the police officer's course of conduct with regard to his speed, especially on that day he pulled Obama over," Harvey said.  "We've learned that there have been numerous incidents in Framingham with regard to his driving pattern as a police officer."
 
The records request is part of the defense's attempt to show Krishtal lacked probable cause to stop Obama -- a contention that, if the court were to agree, could lead to the charges being dropped.
 
In an e-mail to the defense team last week, Middlesex prosecutors disclosed a Nov. 22 crash in which Krishtal, en route to a report of shots being fired, smashed his cruiser into a stone wall.  That same email alludes to "numerous incidents investigated by the Framingham PD over the past several years involving Officer Val Krystal (sic) and the operation of a motor vehicle while on duty."
 
Framingham Deputy Police Chief Craig Davis confirmed that police are reviewing Krishtal's on-duty driving history, but said he lacked specific information on those incidents and referred further questions to Police Chief Steven B. Carl. Carl could not be reached yesterday.
 
"Chief Carl is looking into the matter and, I guess, has discovered a bunch of them," Davis said.
 
Krishtal, 44, has a valid license and, according to Registry of Motor Vehicle records, has not been cited for a traffic offense since 1989.  He declined to comment yesterday.
 
Obama's August drunken-driving arrest brought to light his history as a 20-year immigration fugitive who had been living quietly and holding down a job at a local liquor store.
 
Obama had a blood-alcohol level of 0.14, police said at the time.  Harvey said the defense plans to argue that the testing device was calibrated incorrectly, and that the results should be stricken from evidence.
 
"We'll be attacking that, as well as the procedures the police officer utilized while he was operating the Breathalyzer," Harvey said.

Attorney Harvey, III, is something of an expert on motor vehicle violations.
  

He was suspended from the practice of law for six months by order dated April 26, 2002.
  

On May 9, 2001, the respondent admitted to sufficient facts in the Lowell District Court to the crime of assault with a dangerous weapon, a car, in violation of G.L. c. 265, § 15B.  The respondent, while operating his automobile, twice attempted to strike another lawyer.  The victim was able to jump out of the way without being hit.  The court continued the case without a finding for two years on condition that the respondent have no avoidable contact with the victim and that he continue in counseling.
   
So, who's paying the bill for all this high-priced legal talent?

And who paid for Auntie Zeituni's high-priced legal talent?

Romney says deport Uncle Omar

Michael Falcone is reporting that Mitt Romney told a Boston talk radio host on Wednesday that he supports the deportation of Barack Obama’s Kenyan-born uncle who was arrested this fall on drunken driving charges in Massachusetts.

When asked by Boston radio personality Howie Carr whether Obama's relative, Onyango Obama, should be deported, Romney said, "Well, if the laws of the United States say he should be deported, and I presume they do, then of course we should follow those laws," Romney said. "And the answer is 'yes.'"

When Carr brought up Onyango Obama case, Romney first sought clarification: "Who is Uncle Omar, Howie?" the former Massachusetts governor asked the radio host.

Carr explained that the uncle, nicknamed "Omar," was recently arrested in Framingham, Mass.

"Now he’s claiming he’s got a Social Security number and drivers' license and no one knows how he got them," Carr told Romney, "but they’re apparently legit even though he’s in the country illegally." (Onyango Obama had reportedly defied a 1992 deportation order.)
 

 
Omar probably got his Social Security number from the same crook that Barack Obama got his from.

Marie Szaniszlo is reporting that Barack Obama’s illegal alien half-uncle argued in court today that his arrest on a drunken driving charge this summer violated his constitutional rights and he wants evidence suppressed and the case thrown out.

Onyango Obama’s lawyer said in Framingham District Court today that he will file a motion to suppress an Aug. 24 traffic stop, claiming he questions the legality of the illegal alien’s arrest on a charge of driving under the influence of alcohol. The arrest, Attorney P. Scott Bratton said, violated Obama’s Fourth Amendment right against unlawful search and seizure.

The motion to suppress will be for the entire traffic stop by police in Framingham that night on claims Obama was not committing any motor vehicle violations.

Obama blew a .14 on the Breathalyzer following the 7 p.m. stop, police reported, well above the legal limit of .08.

Obama, a liquor store clerk who entered the United States illegally from Kenya and has defied a deportation order for nearly two decades, is accused of driving drunk and nearly crashing in to an unmarked Framingham police cruiser.

Obama is the half-brother of Barack Obama’s alleged father.

A hearing on the motion is scheduled for Jan. 12. Obama, who is 67 years old and was called "Uncle Omar" by Obama in his book "Dreams From My Father," has pleaded not guilty.

At last report, Obama had resumed work at Conti Liquors in Framingham after his release from custody.

   

I don't know -- he looks more like a relative of Michelle to me.

Dreams from his uncle, continued . . .

Scott Johnson says we have followed the saga of Obama’s uncle Onyango since he was apprehended for drunk driving in Framingham, Massachusetts, in mid-August.  Uncle Onyango had a near collision with a Framingham police car outside the Chicken Bone Saloon a block from Uncle Onyango’s Framingham home.  "I think I will call the White House," Uncle Obama said when the the arresting officer offered him his one phone call.  Uncle Onyango apparently hadn’t heard that his nephew was vacationing over on "The Vineyard."

The saga of Obama’s Uncle Onyango is interesting in itself.  Taken together with the saga of Obama’s Aunt Zeituni, it also tells you just about everything you need to know about the farcical non-enforcement of our immigration laws.  Running a background check upon his apprehension, the Framingham police discovered that Uncle Onyango had been subject to a deportation order since 1992.  The police turned him over to immigration authorities, who detained him in the Plymouth County House of Correction.  Uncle Onyango was released without comment by the immigration authorities last month and then mysteriously dropped from sight.

Uncle Onyango reappeared this week for his arraignment in state court on the drunk driving charge.  At court Uncle Onyango was amused by the scene.  Accompanied by two attorneys and an unidentified male supporter, Uncle Onyango giggled his way through the proceedings (video).

Why is this man lauging?  Hey, life is good.  Uncle Onyango is back on the job at Conti Liquors in Framingham, where he can presumably take advantage of the employee discount.  There’s a joke or two here somewhere alright.

Is Uncle Onyango working legally?  That is a great question, one to which the Boston Herald has unsuccessfully sought the answer.  But thanks for asking!

"We have to bring drunken 'Uncle Omar' in front of the House Judiciary Committee"

Justin Sink is reporting that Rep. Steve King (R-IA), a member of the House Judiciary Committee, said Monday that Congress should question Barack Obama's uncle Onyango Obama to see if he received preferential treatment during his deportation proceedings.

"We have to bring drunken 'Uncle Omar' in front of the House Judiciary Committee, drill down into this, and tell America what's going on," King said on Fox News.

Onyango was arrested last month for driving under the influence and nearly hitting a police car.  He had been held in a Massachusetts jail on charges stemming from a 1992 immigration order to return to his native Kenya, but was released last Thursday.

"If any one of us … nearly ran over a police officer, we would face the full fury of the law," King said.

The congressman went on to say that he believed that Obama's uncle would receive preferential treatment from the Department of Homeland Security, and cited the case of Obama's aunt, who was discovered living in Boston as an illegal immigrant during the 2008 election.  An immigration judge reversed an original court order and granted Zeituni Onyango, Obama's aunt, political asylum in 2010.

"I watched as President Obama's aunt, Zeituni Onyango, also evaded [Immigration and Customs Enforcement]," King said.  "The sympathy, the bleeding heart, of [Department of Homeland Security Director] Janet Napolitano decided to use an administrative authority to grant President Obama's aunt asylum."

House Judiciary Committee Chairman Lamar Smith (R-Texas) said last week that he believed that Onyango's release on his own recognizance was indicative of unfair influence.

"It appears there is a double standard -- one for President Obama’s family and one for everyone else," Smith said in a news release.  "Last year, President Obama’s illegal immigrant aunt was granted asylum and now his illegal immigrant uncle has been released from [Immigration and Customs Enforcement] custody, even though he was arrested by authorities for drunk driving."

The White House has said that they have not tried to intervene on Onyango's behalf.

"We expect it to be treated -- and I refer you to ICE and [the Department of Homeland Security] -- like any other immigration case," White House press secretary Jay Carney said.

But Republicans see the case as an opportunity to hit Obama on his recently announced immigration policy, in which officials were instructed to exercise prosecutorial discretion in deportation cases.  Under that policy, the government would focus resources on deporting those considered national security or public safety threats.

"President Obama’s backdoor amnesty allows drunk-driving illegal immigrants like his uncle to remain in the U.S.," Smith said. "His immigration policies are a risk to both public safety and American lives.  Why should citizens and legal immigrants be threatened by drunk driving illegal immigrants when the administration can deport them?"

Obama’s uncle quietly released from jail

Boston.com is reporting officials released Barack Obama’s uncle from Plymouth County jail yesterday after holding him for more than two weeks on an immigration detainer for violating an order to return to his native Kenya in 1992.

US officials refused to disclose any other information about Onyango Obama, who remained in the United States undetected until Framingham police arrested him Aug. 24 on drunken driving and other charges.

Yesterday, federal immigration officials refused to say whether the 67-year-old Framingham resident posted bond, whether they are keeping track of his whereabouts, or even whether they are still seeking his deportation, raising questions about public accountability in the case.

The US Immigration and Customs Enforcement website confirmed Obama’s release by listing him as "not in custody."

Although the website confirmed it, Brian P. Hale, an agency spokesman, said he would not comment on the case because privacy laws and the agency’s policies prohibit it. He said the database is accurate, however.

As a result of the immigration agency’s refusal to discuss the case, it is unclear what happened to Obama after he left the Plymouth County House of Correction -- or whether he could be returned to jail.

An official at the Plymouth County House of Correction who would not give his name said yesterday afternoon that Obama was no longer in custody.  He had been taken to Burlington, where US Immigration and Customs Enforcement has offices, he said.

In Framingham, the people who shared a modest frame house with Obama on a residential street said they did not know where he was.  A co-worker at Conti Liquors, where Obama worked, said they had not heard of his release.

His Cleveland lawyers, Margaret Wong and Scott Bratton, were unavailable for comment, and an assistant said they had not been notified that he was released.

Onyango Obama was the half-brother of Obama's late father.  At the time of his arrest, Obama allegedly told Framingham police, "I think I will call the White House" to arrange bail.

But last week the White House press secretary, Jay Carney, said Obama did not expect his uncle to receive special treatment.

Jessica Vaughan, director of policy studies at the Center for Immigration Studies, which favors tougher limits on immigration, said the immigration agency should be more transparent, especially in a case involving a relative of the president.  She said the public deserves to know the circumstances of Obama’s release, since he violated a deportation order and is accused of drunken driving.  In a criminal court, she said, that would be public information.

Obama pleaded not guilty in Framingham District Court to charges of drunken driving, negligent operation, and failing to yield.

"This whole nonsense about privacy is a policy," Vaughan said.  "It’s not the law.  It’s a choice that [the immigration agency] is making.  I think it’s very cowardly on [the agency’s] part, to be honest.  Their behavior shows that they don’t want to be accountable to anybody."

"President Obama's 'Uncle Omar' is the face of what is wrong with the Obama administration's lawless and dangerous approach to illegal immigration . Instead of being deported, as the law requires, Uncle Omar was allowed to roam the streets and endanger the lives of innocent people, including a law enforcement officer," said Judicial Watch President Tom Fitton.

"And Uncle Omar is exactly the kind of person that local police would have been able to easily keep off the streets as a result of new immigration laws in states such as Arizona and Georgia, which are being challenged in court by the Obama administration," he said.
